Business consultingThe new regime is the default. It gives a ₹75,000 standard deduction and a Section 87A rebate that takes tax to nil up to ₹12 lakh of total income — but no 80C, no 80D, no HRA. The old regime keeps every deduction at higher slab rates. Which one wins depends entirely on how much you actually claim.
Indicative estimate for salary and other-sources income under FY 2025-26 slabs, including the Section 87A rebate, marginal relief around ₹12 lakh in the new regime, surcharge and 4% cess. It does not compute capital gains at special rates under Sections 111A, 112 or 112A, crypto under 115BBH, business income, AMT, or every Chapter VI-A deduction. Business and professional taxpayers who opt out of the new regime must file Form 10-IEA before the due date, and the choice is not freely reversible each year. Have the final position verified before you file.

The new regime is the default for FY 2025-26. It gives a ₹75,000 standard deduction and a Section 87A rebate that takes tax to nil up to ₹12 lakh of total income, but disallows 80C, 80D, HRA, LTA and self-occupied home-loan interest. The old regime charges higher slab rates but allows all of them. In practice the old regime tends to win only where HRA, home-loan interest, 80C and 80D together are substantial — the crossover point moves with your salary structure, so it should be computed rather than assumed. Note that salaried taxpayers can switch each year, while business and professional taxpayers must file Form 10-IEA to opt out and cannot switch freely.
Find the response deadline on the notice before anything else — it is usually shorter than people expect, and an unanswered notice becomes an ex-parte order or a confirmed demand. Then identify what is actually being asked: an intimation under Section 143(1) is not a demand for explanation, while a 142(1) or a GST ASMT-10 very much is. Under the Income-tax Act, 1961. The Income Tax Act, 2025 applies to income earned from FY 2026-27 onwards — Tax Year 2026-27, filed in 2027. Assessments, rectifications, appeals and updated returns relating to AY 2026-27 and earlier years all continue under the 1961 Act. This trips up a lot of replies drafted this year: quoting a 2025 Act section in a 1961 Act proceeding weakens the submission. Our Section Finder maps between the two.

Usually yes, through an updated return under Section 139(8A), available within 48 months from the end of the assessment year. The cost rises the longer you wait — additional tax of 25%, 50%, 60% or 70% depending on which year you file in, over and above the regular tax and interest. Two limits matter: an ITR-U cannot be used to claim a refund or reduce your declared tax, and it cannot be filed where assessment or search proceedings are already pending for that year. At minimum: PAN linked with Aadhaar, Form 16, your AIS, TIS and Form 26AS downloads, bank statements, a pre-validated bank account for refunds, and proofs for the deductions you intend to claim. Capital gains cases need the broker statement, mutual fund CAS and property deeds; business cases need books, GST returns and the prior audit report; notice cases need the full notice PDF with its DIN.
