Understanding Form 15CA — 4 Parts Explained

Form 15CA has 4 parts. Which part you file depends on whether the payment is taxable, the amount, and whether you have a CA certificate or AO order.

Taxable ≤ ₹5L

Part A

Taxable remittance — up to ₹5 Lakh in FY

Self-declaration by remitter. No CA certificate (Form 15CB) required. Filed when the taxable remittance or aggregate does not exceed ₹5 lakh during the financial year.

  • No Form 15CB needed
  • Self-declaration by payer
  • File online on incometax.gov.in
  • Submit acknowledgement to bank
AO Certificate

Part B

Taxable > ₹5L + AO Order u/s 195/197

Filed when taxable remittance exceeds ₹5 lakh AND you have obtained an order/certificate from Assessing Officer under Section 195(2), 195(3), or 197 (lower/nil TDS certificate).

  • AO order details required
  • Lower TDS rate as per certificate
  • No Form 15CB needed
  • Commonly used for NRI property sales
CA Certificate

Part C

Taxable > ₹5L + CA Certificate (15CB)

The most common part. Filed when taxable remittance exceeds ₹5 lakh, no AO order obtained, and a Chartered Accountant has issued Form 15CB. CA verifies TDS, DTAA, and compliance.

  • Form 15CB from CA mandatory
  • CA verifies DTAA, TDS, tax liability
  • 15CB acknowledgement linked to 15CA
  • Most NRO repatriations use this part
Not Taxable

Part D

Remittance NOT chargeable to tax

Filed when the remittance is not chargeable to tax under Income Tax Act — e.g., return of capital, exempt income, certain personal transfers. No 15CB required.

  • Non-taxable payments only
  • No Form 15CB needed
  • Import payments, personal gifts
  • Exempted transfers under Rule 37BB

Foreign Remittance — Frequently Asked Questions

What is Form 15CA and 15CB for remittance outside India?

Form 15CA is an online declaration filed by the remitter on incometax.gov.in before sending money outside India. It ensures TDS compliance on payments to non-residents. Form 15CB is a certificate issued by a Chartered Accountant certifying the nature of payment, applicable TDS rate, DTAA provisions, and tax compliance. 15CB is mandatory when taxable remittance exceeds ₹5 lakh in a FY and no AO order exists.

What is the LRS limit and who can use it?

Under RBI's Liberalised Remittance Scheme (LRS), all resident individuals (including minors through guardians) can remit up to USD 250,000 per financial year. This covers education, medical, travel, investment, gift, maintenance, and other permitted purposes. The limit is per person per year — a family of 4 can send up to USD 1 million. Companies, firms, and trusts cannot use LRS.

What is TCS on foreign remittance? Can it be refunded?

From 1 April 2025, TCS (Tax Collected at Source) under Section 206C(1G) applies on LRS remittances above ₹10 lakh per FY. Rates: Education (self-funded) 5%, Education (loan u/s 80E) 0%, Medical 5%, Tour packages 5%/20%, Other purposes 20%. TCS is NOT an extra cost — it reflects in Form 26AS and is fully adjustable against your income tax liability when filing ITR. If no tax is payable, you can claim a refund of the entire TCS amount.

How can NRIs repatriate funds from NRO account?

NRIs can repatriate up to USD 1 million per FY from NRO to NRE or foreign bank account. Process: (1) Ensure all Indian income is taxed and ITR filed, (2) Get CA certificate in Form 15CB, (3) File Form 15CA online, (4) Submit 15CA acknowledgement + A2 form + documents to bank, (5) Bank processes within 1-3 days. No physical presence in India required — the entire process can be done remotely with CA Alok Kumar's assistance.

When is Form 15CA / 15CB NOT required?

Rule 37BB lists 33 categories of payments where 15CA/15CB is not required — including imports, education fees, medical treatment, travel expenses, gifts to relatives, and other personal transfers by individuals under LRS that don't need prior RBI approval. Also not required when: payment is not taxable under Income Tax Act, payment is credited to NRO account (not remitted abroad), or amount is below ₹5 lakh and not taxable. However, banks may still request forms under internal controls.

What is Section 195 TDS on payments to NRIs?

Section 195 requires TDS deduction on any payment to a non-resident that is chargeable to tax in India — rent, property sale proceeds, professional fees, interest, royalty, etc. TDS rates depend on the nature of income and applicable DTAA. For property sale: 12.5% on LTCG (after indexation), 20% on STCG. NRIs can apply for lower/nil TDS certificate under Section 197 to reduce withholding. The buyer/payer must file TDS return and issue Form 16A.

What is the penalty for not filing Form 15CA / 15CB?

Under Section 271I, penalty of up to ₹1,00,000 for non-filing or furnishing inaccurate information in Form 15CA. Banks will refuse to process the remittance without a valid 15CA acknowledgement. Filed Form 15CA can be withdrawn within 7 days if needed. There is no time limit for filing 15CA, but it must be filed before the remittance is made.

What documents does the CA need for Form 15CB?

For Form 15CB, provide: PAN of remitter and remittee (if available), passport copy (for NRIs), last 2-3 years ITR copies, Form 26AS / AIS, NRO & NRE bank statements, property sale agreement (if applicable), TDS challans, TRC (Tax Residency Certificate) for DTAA benefit, Form 10F (for non-residents claiming DTAA), and invoice/contract for the payment. CA Alok Kumar's team provides a detailed checklist upon engagement.
