Point Wise Summary of the Case
- A Constitution Bench of Honourable Supreme Court, Comprising Justices S Abdul Nazzer, BR Gavai, AS Bopanna, V Ramasubramanian and BV Nagarathna, is considering a clutch of approximately 60 partitions challenging the Central Government’s Decision of Demonetisation of Old Rs. 500 and rs. 1000 Currency Notes.
- The bench has decided to examine the issue after observing that the issue may not have become academic.
- Attorney General R Venkatramani and solicitor General Tushar mehta repeated that “when the act is not challenged, the notifications can not be challenged, that too without a context. The issues are academic and there are political implications”.
- Honourable Supreme Court has directed the Central Government and Reserve bank Of India to file Comprehensive Affadavits on the decision making process of Demonetisation.
- Central government is directed to keep all files ready relevant to Centre’s Nov 7 2016 fleeter to RBI, decision taken by RBI Board the next day and the immediate announcement of Demonetisation.
