Government Clarifies New MDR Rules for Consumers and Merchants<\/strong><br><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Will Google Pay, PhonePe, Paytm, BHIM or other UPI payments soon start attracting transaction charges?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Following discussion around a proposed amendment to India&#8217;s payment law, concerns emerged that the era of completely free UPI transactions could be coming to an end.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Ministry of Finance has now issued an important clarification dated <strong>8 August 2026<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer for ordinary consumers is straightforward:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No transaction charge is proposed on consumers making UPI payments.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Person-to-Person or <strong>P2P UPI transfers will also continue to remain free<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the position for merchants may eventually become slightly different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government has indicated that if Merchant Discount Rate or <strong>MDR<\/strong> is introduced in future, it could apply only to a <strong>limited category of merchant transactions above a specified threshold<\/strong>, and at a nominal rate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the important distinction is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>UPI is not becoming chargeable for ordinary consumers. The proposed change relates primarily to the possible future economics of certain merchant transactions.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The clarification was issued by the Ministry of Finance through the Press Information Bureau on 8 August 2026.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>What Exactly Has the Government Clarified?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The Government has specifically stated the following:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Type of UPI Transaction<\/strong><\/td><td><strong>Proposed Position<\/strong><\/td><\/tr><tr><td>Consumer making UPI payment<\/td><td><strong>No class=\"wp-block-paragraph\">Therefore, headlines suggesting that <em>all UPI transactions will now become chargeable<\/em> would not correctly reflect the Government&#8217;s clarification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Ministry has expressly stated that even if MDR is introduced, the <strong>vast majority of merchant transactions are intended to remain free<\/strong>, and the levy would be threshold-based rather than a blanket charge.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>What Is MDR on UPI?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>MDR \u2014 Merchant Discount Rate \u2014 is a charge associated with processing a digital payment received by a merchant.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Traditionally, merchants accepting card payments may incur MDR or similar payment-processing costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">UPI has followed a substantially different model.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since <strong>1 January 2020<\/strong>, MDR has not been charged on prescribed UPI and RuPay debit-card transactions under the existing statutory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parliamentary material relating to India&#8217;s digital-payment ecosystem also records that MDR was earlier reimbursed by the Government for specified transactions and that, from 1 January 2020, UPI and RuPay debit cards continued under the zero-MDR framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This zero-MDR approach played an important role in encouraging merchants\u2014from major businesses to neighbourhood shops\u2014to accept QR-code payments.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Is the Government Introducing MDR on Every UPI Payment?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most important part of the entire development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government has not announced a blanket MDR on UPI transactions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the proposed framework would enable an MDR to be considered for <strong>a limited set of merchant transactions exceeding a specified threshold<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means a future framework could theoretically distinguish between, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ordinary low-value merchant transactions; and<\/li>\n\n\n\n<li>comparatively higher-value commercial transactions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The actual transaction threshold and applicable MDR rate have <strong>not been specified in the PIB clarification<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, it would be premature to state that a particular transaction value\u2014\u20b92,000, \u20b95,000, \u20b910,000 or any other amount\u2014will definitely attract MDR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The final position will depend upon the legal amendment and subsequent framework prescribed by the competent authorities.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>What Is Changing in the Payment and Settlement Systems Act?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed change relates to <strong>section 10A of the Payment and Settlement Systems Act, 2007<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Ministry of Finance, the <strong>Taxation and Other Laws (Amendment) Bill, 2026<\/strong> proposes to amend section 10A of the PSS Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government describes the amendment as an <strong>enabling provision<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An enabling provision does not itself mean that every UPI transaction automatically becomes chargeable from the day the law is amended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the PIB clarification, after Parliament passes the proposed legislation, the <strong>\u201cUPI and Services Steering Committee\u201d headed by NPCI<\/strong> would decide on MDR, if any.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, there are effectively two separate stages:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Stage 1 \u2013 Legislative change<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory restriction needs to be modified so that an appropriate MDR framework can legally be considered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Stage 2 \u2013 Operational decision<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The relevant committee would subsequently determine whether MDR should actually be introduced and, if so, for which merchant transactions, threshold and rate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is an important difference between <strong>allowing the possibility of MDR<\/strong> and <strong>actually levying MDR<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Will Customers Be Charged for Paying a Shop Through UPI?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Government&#8217;s current clarification:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consumers making UPI payments will not face transaction charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if a consumer scans a merchant&#8217;s QR code and makes a payment, the Government&#8217;s stated policy is that the <strong>consumer should continue to make the payment without a UPI transaction fee<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If MDR is eventually introduced for a specified merchant category, it would be part of the merchant-side payment ecosystem rather than a direct UPI usage charge levied on the consumer under the announced framework.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Will Sending Money to Friends or Family Become Chargeable?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Again, <strong>no<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Ministry of Finance has specifically clarified that <strong>all Person-to-Person (P2P) transactions will continue to remain free<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sending money to a family member;<\/li>\n\n\n\n<li>transferring money to a friend;<\/li>\n\n\n\n<li>sharing expenses;<\/li>\n\n\n\n<li>making a personal transfer between individuals.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, the proposed MDR discussion should not be confused with ordinary P2P UPI transfers.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>What About Small Merchants and Local Shops?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The Government&#8217;s statement is particularly relevant to small businesses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It says that the <strong>vast majority of merchant transactions will remain free<\/strong>, and any future MDR would apply only to a limited category of merchant transactions beyond a prescribed threshold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This suggests that the framework is intended to protect routine and relatively small-value digital transactions from payment-processing costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, merchants should wait for the final notification\/framework before assuming whether they fall inside or outside any future threshold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Businesses should also remember that the <strong>payment mechanism does not determine the taxability of the underlying transaction<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A sale received through UPI remains part of the merchant&#8217;s business receipts and should be appropriately recorded in books of account and reconciled with applicable <a href=\"https:\/\/caalokkumar.com\/itr-filing.html\">income-tax return filing<\/a>, GST and accounting records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question of MDR is therefore separate from the tax treatment of the underlying sale.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Why Does the Government Want the Power to Introduce MDR?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The Ministry has given three principal reasons.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>1. Rising Cost of UPI Infrastructure<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">UPI transaction volumes have expanded substantially.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That requires continuous investment in:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>technology infrastructure;<\/li>\n\n\n\n<li>cybersecurity;<\/li>\n\n\n\n<li>system capacity;<\/li>\n\n\n\n<li>fraud prevention;<\/li>\n\n\n\n<li>reliability; and<\/li>\n\n\n\n<li>risk management.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Government&#8217;s argument is that a payment system operating at such enormous scale requires a sustainable source of investment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>2. Greater Competition<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A viable payment ecosystem also requires banks, payment-service providers and technology companies to continue investing in the network.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Government, a sustainable economic model can encourage more participants and competition in digital payments.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Reducing Long-Term Dependence on Subsidies<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Government has historically supported the UPI ecosystem through incentive schemes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its current position is that reliance exclusively on subsidies may not be sufficient to support the next stage of UPI&#8217;s growth.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed framework therefore seeks a balance between:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>keeping UPI affordable and inclusive<\/strong><strong><br><\/strong>and<br><strong>making the ecosystem economically sustainable.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>How Big Has UPI Become?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The scale explains why the debate over its funding model is important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the Ministry of Finance, UPI processed approximately:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2,366 crore transactions in July 2026 alone<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">with a total value of approximately:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u20b929.9 lakh crore.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government also states that UPI is currently live in <strong>11 foreign countries<\/strong>, with additional countries expressing interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NPCI describes UPI as an instant payment system developed by the National Payments Corporation of India, an RBI-regulated entity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The issue is therefore no longer simply whether QR-code payments should remain inexpensive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The larger policy question is how India can maintain a payment infrastructure processing billions of transactions while continuing to invest in security, innovation and reliability.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Present Position vs Possible Future Position<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction will help taxpayers and businesses understand the development correctly.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Issue<\/strong><\/td><td><strong>Position Now \/ Government Clarification<\/strong><\/td><\/tr><tr><td>UPI charge on framework<\/strong>, rather than an announcement that every UPI payment will immediately become chargeable.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>An Illustration<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose three transactions take place:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Transaction 1<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Rahul sends \u20b915,000 to his brother through UPI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a <strong>P2P transaction<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Government&#8217;s stated position, it continues to remain free.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Transaction 2<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A customer pays \u20b9800 through UPI at a neighbourhood grocery store.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government says the vast majority of merchant transactions will continue to remain free.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the proposed framework is intended to protect routine payments of this nature, subject of course to the final threshold\/rules.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Transaction 3<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A customer makes a substantial UPI payment to a large commercial establishment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a future MDR framework specifies a threshold and the transaction falls within the prescribed category, an MDR could potentially apply to the merchant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, <strong>the customer is still not proposed to be charged for making the UPI payment<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This illustration is only to explain the proposed policy structure. The actual threshold, merchant categories and MDR rates will depend upon the final regulatory framework.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Could Merchants Pass MDR Cost to Customers?<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This will require careful attention once the final MDR framework is notified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Government&#8217;s present announcement states that <strong>consumers will not face transaction charges for making UPI payments<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether and how merchants account commercially for their own payment-processing expenses is a different matter and may depend upon the final regulatory terms, applicable consumer-protection requirements and contractual arrangements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, businesses should not presently begin adding an arbitrary \u201cUPI charge\u201d to customers merely because an enabling amendment has been proposed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The actual rules should first be notified.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Accounting and Tax Treatment of MDR for Businesses<\/strong><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Although the final MDR framework is not yet available, if MDR is eventually charged to eligible merchants, businesses will need to account for it appropriately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, if:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Gross customer payment:<\/strong> \u20b91,00,000<br><strong>MDR\/payment processing deduction:<\/strong> \u20b9100<br><strong>Net settlement by payment provider:<\/strong> \u20b999,900<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">the business should ordinarily not treat \u20b999,900 as the gross turnover merely because that is the amount received in the bank.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The gross sale\/receipt remains relevant for accounting and taxation, while the payment-processing charge would ordinarily be separately accounted for as an expense, subject to the applicable tax and accounting treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is important because digital settlement deductions can otherwise create discrepancies between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sales recorded in books;<\/li>\n\n\n\n<li>bank credits;<\/li>\n\n\n\n<li>GST turnover;<\/li>\n\n\n\n<li>income-tax turnover;
